1 · Agreement

These terms are an agreement between you and Pixeyo (contact: pixeyo@gmail.com) about the Waylark iOS app. By installing or using the app you accept them. The app is distributed through the Apple App Store; Apple's standard Licensed Application End User License Agreement also applies, and where the two conflict on a consumer-protection matter, whichever gives you more protection wins.

2 · Use your own judgment — the rule that outranks everything

Waylark suggests small, optional “detours” — little activities meant to gently break your routine. They are invitations, not instructions, and you take them entirely at your own discretion and risk.

• Only do a detour if it is safe, legal, and right for you in the moment. Mind your surroundings, traffic, weather, your health and your limits. Don't trespass, don't go anywhere you shouldn't, and stop if something doesn't feel right.
• The prompts are written to be gentle, low-cost and low-risk, with seated, indoor and low-energy variants — but they are general suggestions, not personal advice, and they are not medical, legal, financial or safety advice.
• You are responsible for your own choices and conduct on a detour, and for anyone in your care. To the extent the law allows, Waylark and Pixeyo are not liable for what happens when you act on a suggestion.

3 · License and acceptable use

You get a personal, non-exclusive, non-transferable license to use Waylark on Apple devices you own or control, for personal use, under the App Store rules. You may not reverse-engineer the app except where the law expressly permits it, resell it, or redistribute its detour content as your own.

4 · Waylark Pro (subscription or one-time purchase)

• Pro unlocks every detour pack. It is offered as an auto-renewing subscription — Monthly (US $2.99) or Yearly (US $19.99, with a 7-day free trial for new subscribers) — or as a one-time lifetime purchase (US $39.99, non-consumable). Your local price is shown in the App Store.
• A subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. Manage or cancel any time in Settings → Apple ID → Subscriptions. A free-trial period, if offered, ends when the paid subscription begins, and any unused portion is forfeited when you buy a subscription that includes it.
• Payment, receipts, renewals, restores, and refunds are handled entirely by Apple; refunds go through reportaproblem.apple.com.
• Pro unlocks content only — the six premium vibe packs. The core experience is free and never paywalled or delayed: a real detour every day from the Wander and Connection packs, your route, streak, badges, notes, photos, widgets and the share card. If Pro lapses or is refunded, the app returns to the free packs and never deletes or locks your route, completions, or notes.

5 · Your data

Everything you record stays on your device — there is no account and no server (see the privacy policy; the App Store label is “Data Not Collected”). That means you hold the only copy: you are responsible for your own device backups, and deleting the app deletes your data. Anything you share goes only where you send it.

6 · Intellectual property

The app, its design, the dotted-route mark, and its detour writing are owned by Pixeyo and protected by law. You keep everything you create — your notes and photos are yours.

7 · Warranties and liability

The app is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties and we are not liable for indirect, incidental, or consequential damages, or for outcomes arising from acting on a suggestion contrary to section 2. To the extent liability cannot be excluded, it is limited to the amount you paid for the app in the prior twelve months (if any).

Nothing in these terms limits liability that cannot lawfully be limited, or your mandatory statutory rights as a consumer (including, under EU/UK consumer law, conformity remedies, the withdrawal rules as applied by Apple's refund process, and your rights against the seller of record, Apple).

8 · Changes

We may update the app and these terms. Material changes will be reflected on this page with a revised effective date before they apply. The standing commitments do not change: no accounts, no data collection, and the daily detour, route and notes never paywalled.

9 · Governing law

These terms are governed by the laws of Romania, without prejudice to the mandatory consumer protections of the country where you live, which continue to apply in full.
